    This is an interesting thread. The issue of Jake Sully's legal status hasn't really been discussed very much, probably because the only way that could ever really be an issue is if the humans return to Pandora and/or Jake Sully returns to Earth (willingly or unwillingly, it really wouldn't matter) to negotiate or as a prisoner. Since it's unlikely that Jake Sully will ever return to Earth, the only way this might ever come up is if the humans return to negotiate with him and the other Na'vi with the aim of some sort of peace treaty or something like that.

    Technically, his body is still the property of the RDA, and they might want it back, for spiteful reasons, I would guess. Whether they would actually get it (and him) back is another question entirely, but I think they might at least try.

    Or at least, they might make that demand. That question remains for the sequel(s) to answer.

    The question of this thread has been touched on a little bit here and there by some fanfic writers (me included), but has not been delved into very deeply. It will be a most interesting question to be answered in the sequel(s) or the novel Cameron is (allegedly) writing.

    This is an interesting thought, I'm sure back on Earth it would be a topic of discussion not only within RDA but also on the media outlets of the time. On Pandora though, probably a moot point. I would think that I would be "easiest" for the humans to "consider" him dead from a leagal standpoint anyway.
