Jake, his avatar and a legal quandary

On my thoughts for a possible future post about the problems of negotiation with the Na'vi, I realised an interesting problem.

The problem is that can mankind consider the Avatar unit Jake Sully the same being/person as the Human Jake Sully using an Avatar. Its a Ship of Theseus paradox where you can not prove the by transfering the mind of Jake Sully into his Avatar unit you have moved Jake Sully the person into the Avatar unit. Since you can't prove the the avatar Jake Sully is the true Jake Sully then it would be hard for Mankind to negotiate with him, especially in the legal sense.


Even if you legally recognised the Avatar Jake Sully as the true Jake Sully there is the little problems of his body being technically the private property of RDA (it was developed by RDA for RDA operations, to be operated by Tom Sully in the name of RDA). This could lead to the bizarre situation where Jake is legally a slave of RDA, but we'll leave that one before some perverted fan fic author gets any ideas.

I guess in Legal and Bureaucratic terms you have a good point man. But as Quaritch says in one of the deleted scenes while holding Selfridge by the neck: 'They're A LONG Way From Earth'. Don't think anyone cared... All you had there was good scientists, the rest we're mercenaries, as Jake says in the beginning. I don't think anyone used any good sense anymore from the moment Jake was hired as an 'undercover Na'vi' to try and spare the innocent People from the 'Stick'...

Jake is the only one who can drive/use/be his Avatar therefore regardless of who developed it Jake is the owner because without Jake his Avatar is just a useless and insanely expensive pile of organic material. A question that literally no one brings up is; what do they do with the Avatars after 6 years when they rotate back home?

If Jake is transferred to his Avatar he is still himself just in a different body. So Avatar Jake is the real Jake and he shouldn't be beholding to the RDA because in his mind (and ours) they are the enemy and he would no longer do what they say even if his Avatar is technically the "property" of the RDA. With Jake permanently in his Avatar they have no way to control him seeing as they can't just walk up to a machine and push a button to stop the link. This also means that he is now a permanent resident of Pandora and can no longer go back to Earth.

Yeah, on Pandora such arguments have little point but there nice to think about. Also I feel that no one was using any sense when those middle managers decided to sent Jake to Pandora when Tom was killed.
